so the library of congress and the recording industries want to end independent web-casts.

<br>I've been doing the math with their payment scale:
<br>.02 cents per song per listener.
<br>so from one two hour show, I get 300-1000 listeners.
<br>say, average of 550 per two hour show.
<br>two hours = about 30 songs.
<br>550 x 30 = 16500
<br>now, if they say I'm "non-commercial" it's $.0002 per song, per listener.
<br>if I'm "commercial" it's $.0014 per son per listener.
<br>so that's $3.30-$23.10 per show.
<br>$171.60-$1201.20 per year.
<br>seeing as I make nothing off the site.. it puts me more in the hole
<br>I'm going to be mailing out the returntothepit.com mailing list soon on what you can do.

The math does add up. For all of us who are interested in music on the web, this should be an issue. But how do the LOC and the Recording Industries hope to attempt this? It seems a daunting task to block all independant streams. <br> <br>For the Pit's, and others sake, we should try to keep our streams legal, and do what we can to make some opposition heard.

ok, two things. <br>1) I'm going to stop playing all RIAA music on my show (not that I played any before) <br>2) I found a loophole for re-transmission rules: <br><i>The Librarian accepted 0.07˘ per performance, the effective or blended rate rounded to the nearest hundredth, as the rate for Internet-only transmissions and accepted it in principle as the rate for radio retransmissions. However, the law contains an exemption for all radio retransmissions that occur within a 150-mile radius of the originating radio station’s broadcast transmitter. Section 114 (d)(1)(B)(I) of the Copyright Act provides that any retransmission of a nonsubscription broadcast transmission is exempt from the sound recording copyright owner’s digital performance right, provided that “the radio station’s broadcast transmission is not willfully or repeatedly retransmitted more than a radius of 150 miles from the site of the radio broadcast transmitter.”</i> <br> <br>oh shit, did I find the gayest thing: <br><i>Finally, the CARP noted that because many webcasters are currently generating very little revenue, a percentage of revenue rate would require copyright owners to allow extensive use of their property with little or no compensation.</i> <br>So let's charge them money that they can't pay... <br>good thinking brainiacs. <br> <br>ok, here's the date folks: <br><b>The Librarian established September 1, 2002, as the effective date of the rates</b> <br>mark it on your calendar as the day internet radio died. <br> <br>Of course, I'll still be broadcasting..
